Terms of Service

1. Acceptance of terms

By creating an account or using WallyMetrics ("the Service"), you agree to these Terms of Service and to our Privacy Policy. If you use the Service on behalf of a company, you represent that you have authority to bind that company. If you do not agree to these terms, do not use the Service.

2. The service

WallyMetrics provides product research tools for online sellers: live and cached Walmart product data, pricing and seller analytics, Amazon price comparisons, monitoring and alerts, and related features. Product, pricing, seller, and historical data displayed in the Service is obtained from third-party data providers (including Kompy and Keepa) and may be delayed, incomplete, or inaccurate.

3. Accounts

You must provide a valid email address and are responsible for keeping your credentials secure and for all activity under your account. You must be at least 13 years old (or the minimum digital-consent age in your jurisdiction, if higher). Notify us immediately if you suspect unauthorized use of your account.

4. Acceptable use

You agree not to:

  • abuse the Service's API capacity, automate access in ways that impair the Service for others, or circumvent rate limits or quotas;
  • resell, republish as a competing dataset, or redistribute bulk extracts of the Service's data;
  • use the Service to violate the terms of Walmart, Amazon, Kompy, Keepa, Stripe, or any other third party;
  • attempt to access other users' data, probe or scan the Service's security, or interfere with its operation;
  • upload malicious code or use the Service for any unlawful purpose.

We may suspend or terminate accounts that violate these rules.

5. Data sources and no affiliation

The Service displays publicly sourced retail data. WallyMetrics is not affiliated with, endorsed by, or sponsored by Walmart, Amazon, Kompy, Keepa, or any marketplace. All marketplace names and trademarks belong to their respective owners. Sales, revenue, and demand figures are statistical estimates derived from third-party data and should be treated as research approximations, not guarantees of actual marketplace performance. Always verify pricing, availability, and seller information on the marketplace itself before making business decisions.

6. Bring your own key (BYOK)

You may connect your own Kompy API key. You are responsible for that key, for your compliance with Kompy's terms, and for any charges Kompy bills to your plan. We take reasonable care with stored keys but cannot accept liability for charges incurred under your own provider accounts.

7. Subscriptions and billing

  • Access to the Service requires an active subscription (Basic, Standard, or Pro) as shown on the Plans page, unless you have your own provider key grandfathered in.
  • Subscriptions renew automatically at the end of each billing cycle (monthly or annual) until canceled. Prices are shown before checkout and may change with reasonable notice.
  • Payments are processed by Stripe. You authorize us to charge your chosen payment method through Stripe for the plan you select, including renewals until you cancel.
  • You can cancel anytime from your account or by contacting us. Cancellation stops future renewals; your access continues to the end of the paid period.
  • We may suspend access for failed payments after notice.

8. Intellectual property

The Service, its software, and its original content are owned by WallyMetrics or its licensors. Marketplace data remains the property of its respective providers. You receive a limited, non-exclusive, non-transferable right to use the Service for your own internal business research.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT DATA WILL BE ACCURATE, COMPLETE, CURRENT, OR UNINTERRUPTED.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WALLYMETRICS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless WallyMetrics from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these terms, or your violation of any third party's rights or terms of service.

12. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access for violation of these terms, non-payment, or where required by law. Sections 9-11 survive termination.

13. Changes to the service or terms

We may modify the Service or these terms. Material changes to the terms will be announced in the app or by email, and continued use after the effective date constitutes acceptance.

14. Governing law

These terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-law rules, except where mandatory local consumer law gives you different rights.
